Terms and Conditions
Welcome to High Planes Company (HPC). These terms and conditions govern the sale of off-grid packages, including but not limited to solar generators, solar panels, stoves for heating, and water distillers. By browsing this site or purchasing any product, services, or off-grid package from HPC (the “Seller”), you (“Buyer”) agree to the following terms and conditions.
1. Offer and Acceptance
This document constitutes an offer by HPC to sell its off-grid packages, subject to these terms and conditions. Any order placed by the Buyer, whether verbally or in writing, shall constitute acceptance of this offer. Any additional or inconsistent terms proposed by the Buyer will not apply unless expressly agreed upon in writing by HPC.
2. Payment Terms
All descriptions, quotations, proposals, offers, acknowledgments, acceptances, and sales of the Seller’s products are governed exclusively by these terms and conditions. Payment for all orders must be made in full before the items will be shipped, unless otherwise agreed in writing. We accept Visa, MasterCard, Discover, American Express, wire transfers, and checks. In cases where credit terms are extended, payment is due within 30 days from the date of delivery. A 3.5% per month finance charge will apply to delinquent accounts past 60 days, and accounts will be subject to collection.
For custom orders, we do not accept returns or offer payment terms. A partial deposit may be required to begin processing the order, and full payment is required before shipping. By paying the deposit or full amount, the Buyer agrees that the invoice is accurate and reflects the items purchased.
3. Lead Times
Lead times may vary based on the availability of products. Standard orders will typically ship within 1 to 5 business days if the products are in stock. Custom or large orders may take longer, and production times will depend on the complexity and scale of the project. For an accurate estimate, please contact a representative.
4. Shipping and Delivery
The Seller provides shipping quotes as a service to customers. Shipping quotes are estimates provided by carriers and are subject to change. The risk of loss transfers to the Buyer upon delivery to the carrier. If the Buyer opts to arrange their own shipping, all related fees, including incidental and accessorial charges (e.g., lift-gate services, fuel surcharges, or inside deliveries), will be the responsibility of the Buyer. Free shipping is available for local deliveries in certain areas, but restrictions may apply.
All shipping dates are estimates and subject to change. The Seller is not liable for delays in delivery, regardless of the cause. If concealed damage is discovered upon receipt of the goods, a claim should be made with the carrier immediately.
5. Damaged Goods and Shortages
It is the responsibility of the Buyer to inspect and document any damage or shortages at the time of delivery. If any defects or issues are discovered, claims should be made to the carrier without delay. The Seller will assist in addressing these claims but is not responsible for damages caused by shipping carriers.
6. Warranty and Product Use
Each product included in the off-grid packages may come with a manufacturer’s warranty, and the Buyer must refer to the specific product’s warranty terms for details. The Seller does not provide additional warranties and is not responsible for any defects, malfunctions, or damages arising from the misuse, alteration, or improper installation of the products.
7. Return and Refund Policy
Given the nature of custom orders and shipping costs, refunds are typically not provided. However, in the rare instance of a defective product, the Seller may offer a replacement. Any return requests must be made within 30 days of invoicing, and all returns are subject to a 20% restocking fee. Custom-built or non-stock items are non-refundable.
8. Limitation of Liability
The Buyer assumes all risks related to the installation and use of off-grid packages. The Seller is not responsible for any damages, injuries, or losses that occur due to improper use or installation. The Buyer agrees to indemnify and hold harmless the Seller, its affiliates, and its employees from any claims arising from the use of the purchased products, including any negligence on the part of the Buyer.
9. Release of Liability, Assumption of Risk, and Indemnification
By purchasing and using the off-grid packages, the Buyer acknowledges the inherent risks associated with off-grid systems and assumes full responsibility for any damages, injuries, or losses that may result from their use. The Buyer releases the Seller from all claims of liability, whether known or unknown, and agrees to indemnify the Seller from any legal action or claims resulting from the misuse of the products.
10. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of [State], and any disputes arising from these terms will be resolved in the courts of [County, State].
11. Changes, Reschedules, and Cancellations
Changes to orders, including specifications and quantities, or cancellation requests, must be approved in writing by the Seller. The Seller reserves the right to accept or deny any such requests and may impose additional charges for changes or cancellations.
12. Privacy Policy
The Seller values customer privacy and will not sell or share personal information except as required by law or for the purpose of fulfilling an order. Customer information is protected through appropriate safeguards.
